Matters for Resolution (2026)

  • When shall unpermitted docks on Muskrat Lake be removed
  • When shall structures encroaching on 100 year flood plain be removed.
    • There are at least two unpermitted/prohibited structures/docks on the common area of Muskrat Lake.   Neither the State nor the County have expressed interest in resolving issues tied to prohibited structures in 50' wide Riparian Zone around perimeter of Muskrat Lake.  Accordingly it likely will be up to the HOA itself to "self-govern" and resolve issues tied to lake docks.
      • The State owns the water in Muskrat Lake.  The water is a Public Resource.   Nevertheless since Muskrat Lake is "non-navigable" the State evidently has elected to forego jurisdiction over permitting of docks.
      • The County requires permits for "structures" (presumably to ensure proposed structures are consistent with County policy rules and Covenants filed with County).  There does not seem to be an exception for docks/piers/stairs.  No structures are allowed within 50' Riparian Zone (see Covenants filed with County).

  • Neither State or County have expressed concerned interest over blocked walking trail (potential safety hazard and inconvenience for those who like walking/riding) at public access point for Retreat for the reason the road accessing Retreat is private.
